Terms of Use

1. General

These Terms of Use govern the use of datthome.com ("the Website", "we", "us"). By accessing, registering on, or using the Website in any manner, you agree to be bound by these Terms and represent that you are at least 18 years old.

The Website operates as a marketplace platform connecting individuals who host dining events ("Hosts") and individuals who attend dining events ("Guests"). Datthome acts as the Merchant of Record for all transactions processed through the platform, taking responsibility for the booking and payment process on behalf of both parties.

2. Role of the Website

The Website:

  • provides a marketplace platform for listing and booking dining events
  • acts as Merchant of Record and is responsible for processing all transactions and bookings made through the platform
  • does not organize, supervise, prepare, or control any dining events

As Merchant of Record, Datthome is responsible for the transaction itself — billing, payment processing, refunds, chargeback and dispute handling, customer support for payment issues, and applicable tax remittance. Matters relating to food quality, hygiene, allergen disclosure, and event execution are the responsibility of the Host.

3. Responsibility of Hosts

Datthome, as Merchant of Record, takes responsibility for the transaction and booking process. Hosts retain full responsibility for food quality, safety, and event execution. This responsibility is confirmed through legally binding electronic identification (Rafræn skilríki) at onboarding.

Hosting is currently available only to Icelandic residents. Each Host must complete identity verification with Rafræn skilríki and register a Visa or Mastercard payout card before publishing a dinner or receiving a payout.

Hosts are solely and fully responsible for:

  • food preparation, ingredients, hygiene, and food safety
  • providing accurate allergen and dietary information
  • compliance with all applicable laws, regulations, and health standards
  • the accuracy and completeness of information published on the Website
  • the safe and proper execution of all dining events

Food quality, food safety, allergen disclosure, and the physical conduct of dining events are the Host's responsibility. Datthome, as Merchant of Record, handles the transaction side — billing, refunds, chargebacks, payment disputes, and payment-related customer support.

4. Responsibility of Guests

Guests participate in dining events at their own risk and are solely responsible for:

  • their own health, allergies, and dietary choices
  • informing Hosts of allergies or special requirements
  • their conduct during dining events

5. Disclaimer of Liability

The Website and its owners:

  • assume no liability for any dining event listed or booked through the Website
  • assume no liability for illness, injury, allergic reactions, accidents, damages, losses, or disputes
  • make no warranties regarding the quality, safety, legality, or suitability of any dining event

Use of the Website is entirely at the user's own risk.

6. Indemnification

You agree to indemnify and hold harmless the Website, its owners, operators, and affiliates from any claims, damages, losses, liabilities, or expenses arising from:

  • your participation in dining events
  • your breach of these Terms
  • your violation of any law or third-party rights

7. Account Suspension and Termination

We reserve the right to suspend or terminate user accounts and remove content at any time, without prior notice, if we believe these Terms have been violated or the Website is misused.

8. Changes to Terms

We may update these Terms at any time. Continued use of the Website constitutes acceptance of the updated Terms.

9. Payment Terms

All payments on the platform are processed by Esja Fjarskipti ehf (operating as Datthome) via Paystrax COPYandPAY, a PCI-DSS compliant card payment solution. Card data is entered directly into the Paystrax hosted widget and never touches Datthome servers.

Authorization and capture: When you complete the booking form, your card is pre-authorized (PA) for the full amount. The charge is captured only when the host confirms your reservation. If the host does not confirm, the authorization is released automatically.

Currency: All amounts are charged in Icelandic Króna (ISK). Foreign cardholders will be charged in ISK; currency conversion is handled by their card issuer.

Accepted cards: Visa and Mastercard. American Express and other card networks are not accepted.

Refunds: Refunds are governed by the cancellation policy of the individual dining experience. See our Refund & Cancellation Policy for full details. Datthome, as Merchant of Record, is responsible for processing all refunds and handling payment disputes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Iceland. Any disputes shall be subject to the exclusive jurisdiction of Icelandic courts.
